Residual risk in mountain sports

Even if it sometimes looks like mountaineering has become absolutely safe in recent years, everyone should know that there is a certain residual risk. Even if we at ACTIVE MOUNTAINS adhere to all guidelines and doctrinal opinions, we cannot completely rule out that there will be no accidents. No liability can therefore be accepted in the event of accidents, damage, losses or other irregularities. Participation in events is your own responsibility and at your own risk.

insurance

We recommend a rescue cost insurance, which for example with the membership  alpine clubs or is also included in  Automobile clubs and various insurance carriers are to be concluded. ACTIVE MOUNTAINS is not responsible for the control of these insurances.

liability

The liability of ACTIVE MOUNTAINS, their mountain guides and instructors is limited to gross negligence or intent. We exclude liability for slight negligence. If ACTIVE MOUNTAINS provides rental equipment, the rental company is responsible for the safety of the equipment. In any case, ACTIVE MOUNTAINS declines any liability for defects in the personal equipment of the participants.

Framework

The requirements specified in the programs must be met by the participant. A certain amount of prudence and independence is required. If a participant does not meet these requirements, the mountain guide is entitled to exclude him or her from the program in whole or in part. In this case there is no right to a refund. Despite the best tour planning and guidance, we cannot give an unlimited guarantee of success for reaching the program goals or summits. No claims for compensation can be made for tours that are missed due to weather or safety reasons or through the fault of the participant. Loss or repair costs of damage to the rental equipment that go beyond normal wear and tear are to be reimbursed by the participant.

Number of participants, small group surcharge

All events listed in the program can only be held if the minimum number of participants has been reached. If this is not the case, we will try to host the event with your consent  a small group surcharge. You will of course be informed of any price changes that arise. If an event does not take place, it is possible to switch to a neighboring event with similar requirements, taking additional costs into account.

Booking and payment

Registration is only possible in writing by email.  The places  are allocated in the order in which registrations are received. If the minimum number of participants is reached or if a course or a guided tour takes place, you will receive a course confirmation from us. After receiving the course confirmation, the entire amount must be transferred to the ACTIVE MOUNTAINS account. A booking on a waiting list is not a binding booking. Please also note that the booking for ACTIVE MOUNTAINS is only valid when the due payment has been received in full on the ACTIVE MOUNTAINS account! After receiving the amount, you will receive a booking confirmation from us and it is therefore binding.

We are entitled at any time to refuse a customer participation in an event if ACTIVE MOUNTAINS has not received any payment or has not received it on time. Our entitlement to the participation fee remains unaffected. ACTIVE MOUNTAINS rejects any liability for costs incurred or claimed by the customer in this case.

Performance changes

The mountain guide reserves the right to change, restrict or expand the training and tour program due to unforeseeable circumstances. Due to weather conditions or other unforeseeable circumstances, the advertised route cannot always be guaranteed.

Cancellation of events

ACTIVE MOUNTAINS is entitled to postpone dates or times at any time, or in the case of special events such as increased alpine dangers, unfavorable external conditions, illness or prevention, insufficient registrations or other important reasons, to cancel events and thus unilaterally withdraw from the contract. In this particular case, you will usually be informed by email no later than 1 day before the event. All payments already made will be refunded within the specified period. In addition, there are no claims of any kind on the part of the customer.

Withdrawal and cancellation

You have the right to withdraw from the contract at any time in writing by email. If you cancel no later than 21 days before the start of the program, there are no costs.

In the event of a later cancellation, the following cancellation costs arise:

Day 21-14: 15%
Day 14-7: 25%
Day 7-3: 50%
Day 3-1: 75%


24 hours before the start of the event: 100% of the cost

Any cancellation costs for hotels or huts are to be borne by the participant. We recommend that you take out cancellation insurance yourself against the risk of cancellation. If the space vacated by the withdrawal can be resold, there are no costs. If, for whatever reason, the event cannot be held, it can also withdraw from the contract at short notice. In this case, we will offer you a replacement event and possibly repay any amounts that have already been paid.
